Terms of Service
Please read these terms carefully before using Load Outlet.

1. Agreement to these terms
These Terms of Service (“Terms”) constitute a binding agreement between you and Thirtyfour LLC(“Company,” “we,” “us,” or “our”) governing access to and use of the Load Outletwebsite, applications, and related services (collectively, the “Platform”) available at https://loadoutlet.com and associated domains, including loadoutlet.com.
By accessing or using the Platform, creating an account, browsing listings, or completing a purchase, you agree to these Terms and our policies referenced herein. If you do not agree, do not use the Platform.
2. Nature of the Platform
Load Outlet is a technology marketplace platform operated by Thirtyfour LLC. The Company's mission is to build technology services that connect independent merchants with shoppers online.
Except where we expressly identify ourselves as the seller of a specific item, Thirtyfour LLC is not the merchant of record for products displayed on the Platform. Load Outletdoes not take possession of inventory, does not act as the retailer of listed goods, and does not perform product fulfillment. Participating vendors (“Vendors”) list and sell their own products with our permission, and Vendors—not the Company—are responsible for fulfillment, shipping, and vendor-specific policies unless otherwise stated at checkout.
The Platform provides discovery, account management, checkout, payment facilitation, and related tools. Your purchase contract for physical goods is between you and the applicable Vendor, with the Company providing platform services as described in these Terms and in any separate vendor agreement.
3. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or complete purchases. You agree to provide accurate registration information and to keep your credentials secure. You are responsible for activity under your account.
We may suspend or terminate accounts that violate these Terms, applicable law, or Vendor policies, or that pose fraud, abuse, or security risks.
4. Vendor listings and shopper responsibility
Product descriptions, images, prices, availability, sizing, and shipping estimates are supplied by Vendors. We may review Vendors for verification purposes, but we do not guarantee the accuracy of every listing or that a Vendor will meet every expectation. Shoppers should review product details and Vendor information before purchasing.
When you place an order, you authorize us and our payment processors to charge your selected payment method for the total shown at checkout, including applicable taxes, shipping, discounts, and platform fees where disclosed.
5. Fulfillment, shipping, and returns
After a successful checkout, fulfillment is handled by the Vendor (or its fulfillment partner) identified for your order. Delivery times, carriers, tracking, lost-package investigations, defects, and return eligibility are primarily governed by the Vendor's policies and applicable consumer protection laws.
For order-status, shipping, or product issues, contact us through the Platform's support channels so we can help coordinate with the Vendor. Nothing in these Terms limits non-waivable rights you may have under law.
6. Payments, fees, and site credit
Payments are processed through third-party payment providers (such as Stripe). You agree to their terms and privacy practices in addition to ours. We may charge platform or processing fees disclosed at checkout or in Vendor agreements.
Gift cards and site credit, where offered, are subject to the terms displayed at purchase and redemption. Unless required by law, gift cards and site credit are not redeemable for cash and may only be used on the Platform.
7. Promotional codes
Promo codes may be issued by Vendors, the Company, or administrators. Codes may carry expiration dates, product restrictions, geographic limits, or email-specific eligibility. We may modify or cancel promotions that are erroneous, abusive, or inconsistent with stated rules.
8. Vendor program
Vendors apply separately for participation. Approval, commission rates, listing standards, payout timing, and operational requirements are set forth in application materials, vendor portals, and vendor agreements. Vendors represent that they have rights to sell listed products and will comply with applicable laws, including consumer protection, tax, import/export, and intellectual-property obligations.
9. Prohibited conduct
You agree not to:
- Use the Platform for unlawful, fraudulent, or deceptive purposes;
- Circumvent security, scrape data without permission, or overload systems;
- Post false reviews, manipulate pricing, or abuse promotions;
- Infringe intellectual property or privacy rights of others;
- Interfere with Vendor fulfillment or other users' lawful use.
10. Intellectual property
The Platform's design, software, branding, and original content are owned by Thirtyfour LLC or its licensors. Vendor content remains the responsibility of each Vendor. You receive a limited, revocable license to use the Platform for personal, non-commercial shopping and account management in accordance with these Terms.
11. Disclaimers
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
WE ARE NOT RESPONSIBLE FOR VENDOR ACTS OR OMISSIONS, THIRD-PARTY PAYMENT OUTAGES, CARRIER DELAYS, OR EVENTS BEYOND OUR REASONABLE CONTROL.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Thirtyfour LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM YOUR USE OF THE PLATFORM.
OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR PLATFORM SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
13. Indemnification
You agree to indemnify and hold harmless Thirtyfour LLCfrom claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Platform, violation of these Terms, or infringement of third-party rights, except to the extent caused by our gross negligence or willful misconduct.
14. Dispute resolution and governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except where mandatory consumer protections in your home jurisdiction apply.
Before filing a claim, you agree to contact us at info@loadoutlet.com and attempt good-faith resolution. Except for small-claims matters or injunctive relief, disputes that remain unresolved may be brought in the state or federal courts located in New York, and you consent to personal jurisdiction there, unless applicable law provides otherwise.
15. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance of the revised Terms.
